TERMS & CONDITIONS

Terms and Conditions for CM Digital Design Services:

  1. Chris Maloney Digital Design “CMDD” starts working on a project upon receipt of a down payment. Unless otherwise specified in writing, the client is charged the remaining balance upon completion of the project. Websites are made live upon completion of the project, when all payments are cleared. If applicable, hosting and domain name registration fees must be paid every month.
  2. Additional services come at additional fees, on a fee for service basis or on an hourly rate. If clients require additional services, the correspondent fee is added to their invoice and they are charged accordingly.
  3. Delays in project completion may occur when:
  • There is a delay in any payments
  • The client requests further changes in the design, structure, or content of the project
  • The client purchases an additional service related to the project
  • There is a delay in the receipt of any materials form the client

Time frame estimates are approximate only and are subject to change at any time at CMDD’s discretion. At any time, and at its whole discretion, CMDD’s may decide to put a project on hold.

  1. All of my services are 100% satisfaction guaranteed. I don’t stop working until my clients are completely satisfied with their new solution. That is my commitment. However, CMDD will under no circumstances be held responsible to satisfy unreasonable expectations or requests. It remain my discretion to decide whether or not a request or an expectation is reasonable or lies within the scope of offer of services to its client. As an example, if the client purchases a particular service, but in order to be fully satisfied, CMDD judges that an additional service is necessary, then it is no longer CMDD’s responsibility or commitment to satisfy the client. In other words, CMDD guarantees 100% satisfaction within the framework of its original agreement with the client, according to CMDD’s understanding during initial consultations. These may be via email, telephone or in person.
  2. Services or part of services (i.e. elements of a project) that have been approved by the client are considered as services with which the client is 100% satisfied. Any further work on these services (elements of the project) will be invoiced accordingly.
  3. Unless clearly specified otherwise, all project statuses are set as “completed” after a 3-month period has passed (calculated from the first payment date). This means no more work will be done on that project and no service will be provided. This doesn’t apply to hosting and domain name registration services, which are provided independently of the project status, and only according to the client’s up keep of agreed payments.
  4. If client is not satisfied with CMDD’s Services, client can ask for a refund on any unused monies. CMDD will be happy to exercise a refund, after doing it on review.

Costs, Fees and Charges:

Many of the projects undertaken are on a ‘bespoke project price’. This means that once a specification and time frame is agreed a total cost and potential payment plan will be put in place. The are occasionally cases where projects will be priced on an ‘hourly’ ‘day’ or ‘weekly’ rate. This will be discussed before any project is agreed and begins. The rates charged are:

  • Hourly – £50*
  • Daily – £250*
  • Weekly – £1,100*
  • Minimum charge – £50*

*All prices and subject to change at any point. The rates do not include the cost of software or any other material required for any project. There are occasions for more specialist tasks that these charges will be higher. However, this will be made clear and agreed before any project is started.

Please note: For those that need to provide content and supporting information and a project price is initially agreed, if there are any extensive delays in providing the required information you will be charged as per above. As some projects are for very specific and specialist industries this content will be crucial to the project.

While the required content will be made clear before the project is agreed and the initial invoice been generated, should any changes be made then additional content may be required.

If your business provides packages, products or services then accurate information along with current prices will need to be provided. Should you change any of the above either during or after the completion of the project and they have already have been created then to update them you will be charged as above. For example: If your services and prices are added to a web page, even before its launch, but then you decide to amend either of these you will be charged for the additional time accordingly.

Cancellations and Refunds:

A project would never be started without an initial payment been made, unless otherwise pre agreed. Once a project and cost has been agreed the initial invoice will the then be issued before any work commences. The invoice will not be issued under any circumstances unless everything has been agreed in writing. Once the invoice has been paid the automatic obvious assumption is made that you wish to proceed with the agreed project.

Refunds will not be accepted or issued upon receipt of any payment. Cancellations are accepted at any point, however a refund will not be issued. If the agreement was an initial part payment with a total payment pre-arranged then the remainder of the total sum will also be invoiced and will follow the below late payment terms. If additional work has been carried out (e.g. additional pages, content, designs etc over the agreed design) then they will also be subject to these charges, based on the most cost effective pro-rota rate (as above).

All aspects of digital design (websites, price lists, branding, marketing etc) are entirely bespoke and individual, which require a significant amount of time. Therefore, they cannot be reused elsewhere or ‘returned’. They are ‘made to order’. It is because of this that refunds are not accepted, especially once the project has begun regardless of level of completion. As a freelancer designer I have to carefully schedule projects around each other therefore I have to plan my diary precisely.

Thankfully there have been no issues to date therefore the above clause has never been an issue. However, in order to project myself the above clause will firmly remain in place.

Project Terminations:

If a client continues to extend, delay or amend any project away from initial agreed designs throughout the build CMDD retains the right to either;

  1. Charge accordingly for the additional time (as per above rates)
  2. Terminate the project entirely

Should a project be terminated throughout the build for any reason (including but not exclusively: extending work, additional tasks, additional content, lack of supplied content, unrealistic expectations) then the above refunds and cancellations terms will be enforced. As mentioned above project timescales are managed carefully to ensure maximum efficiency, therefore any additional work may not be possible or will be subject to extended completion dates. While CMDD realises this may seem quite obvious there can be occasions where a client may add (for example) 2 days worth of work to a project but this could take weeks to complete. This is purely down to time allocation and availability. Notice of expected completion dates or project rejection/termination will be sent by electronic mail (email) only.

About debit or credit cards data processing:

Please keep in mind that for security reasons, CMDD always:

Prevents unauthorized access, maintains data accuracy, and ensures the correct use of information, through appropriate physical, electronic, and managerial procedures to safeguard and secure the information it collects online and offline.

Currently I do not offer card payment facilities to process transactions. I have made this decision for a number of reasons. These include data protection and reduction of operating costs, to be able to offer exceptional levels of service at a reduced cost to yourselves. Therefore, better value market and passing this saving on to yourselves. This is not been an issue once over the last 2 years, however if it ever is absolutely necessary for terms will be placed and card processing facilities offered.

Late Payments:

Please note that all invoices that are paid late will incur additional charges after 14 days. An administration fee of £5.00 will be added each week to cover the cost of recovery attempts. This will continue each week until for 6 weeks (until week 8 is reached).

Once 8 weeks have passed a 7 Days Statutory Demand Notice will be issued. All services (website, marketing, email etc) will be terminated. Should the late invoice/s then not be cleared within the 7 days legal proceedings will regrettably, but understandably actioned.

I retain the right to terminate access/services at any time, even before the initial 14 days has passed. Should you have any issues in making payment please contact me directly. Failure to contact me or make cleared payment within the above times frames will result in the above process commencing.

Late Payments:

Please note that all invoices that are paid late will incur additional charges after 14 days. This will be a minimum of 10% of the outstanding balance immediately applied to the original invoice value. For example: If an invoice of £500.00 is not cleared within 14 days of due date (invoice issue date) 10% will instantly be applied. This means that £550.00 will then be owed.

For each week that passes an additional 10% will be added each week. For example if an invoice for £500.00 is not cleared within 6 weeks (42 days) the overall amount due will be £700.00 (initial 2 weeks no charges. Then 4 weeks overdue means 4 x £50.00 = £200.00).

Once 8 weeks have passed a 7 Days Statutory Demand Notice will be issued. All services (website, marketing, email etc) will be disconnected. Should the late invoice/s then not be cleared within the 7 days then legal proceedings will be actioned.
